Notice is hereby given that the South Platte Natural Resources District (SPNRD) will hold a public hearing on Tuesday, June 16, 2009, at 9:00 p.m., or 15 minutes following the end of the information session, whichever is later, in Sidney, Nebraska at the Western Nebraska Community College, 371 S. College Drive. A public information session will be held at 8:00 p.m. on the same date and at the same place. The purpose of the hearing is to hear testimony and receive other evidence concerning the proposed amendments to the SPNRD Districtwide Ground Water Management Area Rules and Regulations. The SPNRD Districtwide Ground Water Management Area encompasses all of the land area located within the boundaries of the SPNRD.   Copies of the District’s Districtwide Ground Water Management Area Rules and Regulations including the proposed amendments are available at the South Platte Natural Resources District office, 551 Parkland Drive, P.O. Box 294, Sidney, NE 69162-0294, telephone number 308-254-2377, or refer to the SPNRD website at http://www.spnrd.org.All interested person may appear at the hearing and present testimony and other evidence concerning the proposed amendments to the SPNRD Districtwide Ground Water Management Area Rules and Regulations. Testimony and other evidence relevant to the purpose of the hearing may also be submitted in writing to the SPNRD, or by electronic mail to the SPNRD at rlhorn@spnrd.org by 5:00 p.m., June 23, 2009.  Individuals with disabilities may request auxiliary aids and service necessary for participation by contacting the SPNRD by June 12, 2009.Regarding the proposed amendments to the Districtwide Ground Water Management Area Rules and Regulations:  The proposed amendments revise Rules 6.6.3.1, 6.6.3.2, 6.7.1.1 and Appendix C of the Districtwide Ground Water Management Area Rules and Regulations. The proposed amendments clarify language concerning notifying owner or occupier before entry upon the land, and revises allocation amounts for agricultural uses in Subareas A, B, C, and D for the second 3- year allocation period. A General Description of the Contents of the Proposed Amendments to the Districtwide Ground Water Management Area Rules and Regulations is as follows:1.    The current language in Rules 6.6.3.1 and 6.6.3.2 was deleted and in their place substituted the statutory language as follows: “ The District shall have the power and authority, pursuant to Neb. Rev. Stat. § 2-3232(1), to enter upon any land, after notifying the owner or occupier, for the purpose of conducting studies, investigations, surveys, and research to carry out its authorized purposes.” 2.    Rule 6.7.1.1: Allocations for Irrigation Uses is proposed to be amended for the second, 3-year allocation period, beginning in 2010. The proposed amendments to the allocation amounts in acre-inches for the second, 3-year allocation period by subareas are as follows:Subarea A – Wyoming State Line to Oliver Reservoir (Road 27)    = 42” (3-year total) - changed from 48” Subarea B – Oliver Reservoir (Road 27) to Buffalo Bend (Road 87)    = 48” (3-year total) - changed from 54” Subarea C – Buffalo Bend (Road 87) to Sidney (Road 115)    = 42” (3-year total) - changed from 48” Subarea D – Sidney (Road 115) to Colorado State Line     = 48” (3-year total) - changed from 54” 3.    Appendix C of the Districtwide Ground Water Management Area Rules and Regulations are proposed to be amended to reflect the proposed amended allocation amounts in Subareas A, B, C, and D.Following the public hearing on the proposed amendments to Rules 6.6.3.1, 6.6.3.2, 6.7.1.1 and Appendix C of the Districtwide Ground Water Management Area Rules and Regulations, the SPNRD Board of Directors will make a decision within 90 days of whether to adopt, with or without modifications, the proposed amendments to the Districtwide Ground Water Management Area Rules and Regulations.  MAY 21, 28 JUNE 4    #1800

Pursuant to Neb. Rev. Stat. § 46-718, the South Platte Natural Resources District (SPNRD) and the Nebraska Department of Natural Resources (Department) hereby provide notice that they will hold a public hearing on Tuesday, June 16, 2009 at 7:30 p.m., or 15 minutes following the end of the public hearing for the Basin-Wide Plan for Joint Integrated Water Resources Management of Overappropriated Portions of the Platte River Basin, Nebraska, whichever is later, in Sidney at the Western Nebraska Community College, 371 S. College Drive, to consider the proposed amendment to Rule No. 9 of the SPNRD and Department Integrated Management Plan (IMP).  Rule No. 9 concerns the subject of the Overappropriated Area and the Nebraska New Depletion Plan. All interested persons may appear at the hearing and present testimony or provide other evidence relevant to the issues being considered.  A public information session concerning the proposed amendment to Rule No. 9 will be held at 6:00 p.m. on the same date and place as the public hearing.    The SPNRD and the Department jointly adopted the IMP on June 20, 2008, which became effective on July 20, 2008. At that time, Rule No. 9 was not complete since the overappropriated basin-wide plan had not yet been adopted. The proposed overappropriated basin-wide plan will be presented at the public hearing preceding the public hearing on the proposed amendment to Rule No. 9.  The proposed amendment to Rule No. 9 is consistent with the proposed basin-wide plan.  A description of the geographic area covered by the proposed amendment to Rule No. 9 encompasses all overappropriated land areas located within the boundaries of the SPNRD.  All of the land area located within the boundaries of the SPNRD is to be considered for inclusion in an integrated management subarea.   The proposed amendment to Rule No. 9 completely revises the contents of Rule No. 9 withthe following components: (1) Goals and Objectives, (2) Plan Components, (3) Monitoring and Studies, and (4) Review and Modifications to the Overappropriated and Nebraska New Depletion Plan Portion of the IMP.  A general description of the proposed revisions to the components of Rule No. 9 are: (1) Action items to achieve goals and objectives, which are intended to be consistent with the requirements of Neb. Rev. Stat. § 46-715(3), (2) Non-regulatory action items that include information and education programs, incentive programs and other programs, (3) Ground water regulatory provisions (controls), which will not be implemented unless triggers have been met, and (4) Surface water regulatory actions that will be used in the overappropriated area that are the same as in Rule No. 8 of the IMP. Stat. §  46-715(4)(a), the South Platte Natural Resources District (SPNRD) and the Nebraska Department of Natural Resources (Department) hereby provide notice that the SPNRD and the Department shall hold a public hearing on Tuesday, June 16, 2009 at 7:00 p.m., or 15 minutes following the end of the public information session, whichever is later, in Sidney at the Western Nebraska Community College, 371 S. College Drive, to consider the proposed Basin-Wide Plan for Joint Integrated Water Resources Management of Overappropriated Portions of the Platte River Basin, Nebraska (Plan). The geographic area subject to the Plan is the hydrologically connected area described in the Department’s Order of September 15, 2004.  All interested persons may appear at the hearing and present testimony or provide other evidence relevant to the issues being considered. A public information session concerning the proposed Plan will be held at 6:00 p.m. on the same date and place.The purpose of the Plan is to meet the requirements of Neb. Rev. Stat. § 46-715(4)(a) for those portions of the Platte River Basin upstream of the Kearney Canal Diversion designated as overappropriated by the Department on September 15, 2004. This area is defined in the Department’s Order, which also defines the area in which ground water is hydrologically connected to the overappropriated surface water basin. This Plan applies to the designated overappropriated basin within the following natural resources districts (NRDs): the North Platte NRD, the South Platte NRD, the Twin Platte NRD, the Central Platte NRD, and the Tri-Basin NRD; collectively referred to as the “Platte River Basin NRDs.” This Plan was prepared after consultation and collaboration with stakeholders as required by Neb. Rev. Stat. § 46-715. The Plan serves as the framework for all Integrated Management Plans developed within the Overappropriated Portions of the Platte River Basin.  Additionally, the Plan contains goals and objectives, a description of the studies and monitoring protocols for the future, and the procedures for review and future modification of the Plan. Goals include: 1) to incrementally achieve and sustain a fully appropriated condition, 2) prevent reductions in the flow of a river or stream that would cause noncompliance with an interstate compact or decree or other formal state contract or agreement, 3) keep plan current, and 4) work cooperatively to identify and investigate disputes between ground water users and surface water appropriators, and if determined appropriate, implement management solutions to address such issues.  The Plan includes a variety of objectives for achieving these goals.  There are no controls included in the Plan as those controls will be indentified and adopted in the Integrated Management Plan developed by the District and the Department.  Individuals who wish to attend the hearing and have disabilities may request auxiliary aids and service necessary for participation by contacting the SPNRD or the Department by June 12, 2009.
